Elon Musk did not file a formal appeal of his court defeat against OpenAI before June 1, 2026. A jury in Oakland, California, ruled against Musk on May 18, dismissing all of his claims against OpenAI and CEO Sam Altman on statute-of-limitations grounds. The jury found that Musk had waited too long to bring his lawsuit, which alleged that OpenAI's conversion from a nonprofit to a for-profit company constituted a breach of charitable trust. Musk had sought more than $130 billion in remedies, the removal of Altman from leadership, and a reversal of the corporate restructuring.

His lead attorney, Marc Toberoff, confirmed plans to pursue an appeal at a post-verdict press conference. However, no notice of appeal was filed with the court by the May 31 resolution deadline.
